2025 Marine Corp Marathon – Dream Challenge Participant Fundraising Agreement and General Release and Waiver (“Agreement”)

This is your official invitation to apply to the 2025 Marine Corp Marathon as a Fundraiser for Dream Foundation’s Dream Challenge Team (“Charity Program”).

I understand that this is a legally binding document.

I represent and warrant to Dream Foundation that I am physically fit and healthy to participate in the Marathon, and that my participation is entirely voluntary. I agree to use good judgment in all aspects of my participation in the Marathon, to behave appropriately, and to comply with the rules and requirements for participation.

I understand that participating in the Marathon exposes me to certain risks, which may include, but are not limited to, injury, illness, death, and damage to self-and/or property, whether from exertion, weather conditions, the conditions of the course, vehicular traffic, and contact with other participants. I hereby assume and take full responsibility for any and all risk of harm, injury, illness, death, or damage to myself and/or my property that may occur in connection with my participation in the Marathon.

I hereby grant permission for photographs, videos, and other images (collectively, the “Images”) to be taken of me during the Marathon and assign all rights and interests to the Images to Dream Foundation. I understand that the Images may be used by Dream Foundation and/or its designees in connection with its advertising, promotional and marketing activities, and for other purposes authorized by Dream Foundation, including, but not limited to, use in direct mail marketing, print advertising, posters, billboard advertising, social media posts and the internet; all without any compensation to me. I authorize the use and release of my name and status as a Marathon participant in conjunction with the use of the Images.

In consideration of myself being permitted to participate in the Marathon as a member of the 2025 Dream Challenge Team, I hereby, for myself, and on behalf of my heirs, beneficiaries, executors, successors and assigns, waive, release and forever discharge Dream Foundation and Dream Foundation’s affiliates, and their respective officers, trustees, shareholders, employees, consultants sponsors, coordinating groups, volunteers, representatives and agents (collectively, the “Released Parties”) from any and all liability, claims, damages, or rights of action of whatever nature or description, in equity or at law, present or future, resulting from or relating to my preparation for and participation in the Marathon. This means that I will not sue the Released Parties or any of them, or try to hold them legally or financially responsible, for any harm or injury that might relate to my taking part in the Marathon.

I agree to adhere to all stipulations, rules and regulations of the Marathon and those set forth in the Marathon entry form and participant’s agreement.

I hereby attest that by accepting this Agreement, I have read, fully understand, and agree without exception to all the provisions, terms, conditions, releases, and waivers outlined in this Agreement and that I have agreed to all terms contained herein knowingly and voluntarily. I understand that this agreement is a legally binding document that limits the legal liability of the Released Parties. I attest, under penalty of fraud, that I am at least 18 years of age as of the date that I sign this Agreement. This Agreement must be accepted by Participant prior to consideration by Dream Foundation for acceptance as a member of the 2025 Dream Challenge Team.

IN ADDITION TO THE FOREGOING, PLEASE NOTE THE FOLLOWING KEY POINTS AND OBLIGATIONS:

  • You must comply with all Marathon stipulations, rules and regulations, including without limitation, the pick-up of your entry packet at Marathon designated location(s) during scheduled hours of operation and that you must show government-issued photo identification.
  • Dream Foundation may provide me with one (1) shirt for training purposes or to wear on race day provided I have met the Minimum Commitment.
  • The use of Dream Foundation’s logos and trademarks cannot be used without consent, and you must submit to Dream Foundation what you are planning to create, for prior approval by Dream Foundation, as determined in Dream Foundation’s sole discretion.
  • You must get familiar and read all the instructions provided by the Marathon at the Marathon’s website and e-mails sent by them regarding race details.
  • You must fill out all sections and pages of this application completely, in order for Dream Foundation to consider you for acceptance.
  • You agree to not post anything on Social Media, that in Dream Foundation’s sole discretion, will damage or harm the reputation of Dream Foundation or your association with Dream Foundation, if accepted to the Dream Challenge Team.
  • You agree to follow and comply with all Dream Foundation policies and procedures for participation, including without limitation raising funds towards the Minimum Commitment on the fundraising platform designated by Dream Foundation and adhering to all social media toolkit policies.
